DEFINITIONS

In these terms and conditions (Terms and Conditions), the following definitions will apply:

  1. “Device” means any registration device, entry Scanner or any other registration device used by Millbrook Tournaments Ltd (MTL) at an event operated by MTL.
  2. “Attendee” means a ticket-holding attendee who has purchased a ticket and has accepted MTL’s relevant attendee terms and conditions.
  3. “New Zealand Open” means the event operated by MTL known as the New Zealand Open.
  4. “New Zealand Open App” means the official app in relation to the New Zealand Open, which can be downloaded from the Apple App Store or Google Play.
  5. “Online Services” means all services provided on MTL websites, Devices and App, including but not limited to ticket sales and website.
  6. “Wrist Band” means the official daily wrist band provided to you by MTL when you enter The Landing or The Landing Bistro, which allows you entry and access to the designated hospitality areas in accordance with MTL’s Privacy Policy and MTL’s terms and conditions notified to you from time to time.
  7. “Venue” means the venue located at Millbrook Resort and owned and operated by Millbrook Resort.
  8. “you” or “your” means event attendees, the general public and any other third parties that access Millbrook Resort, MTL’s websites, Apps and events.
GENERAL TERMS & CONDITIONS
  1. The use of information and materials through Online Services is at the users own risk. 
  2. Online Services are subject to copyright, and unauthorised use is not permitted. 
  3. MTL is not responsible for any content contained in any third-party hyperlink accessed through Online Services. 
  4. Online Services are not to be used to breach any legislation or to be used for any unlawful purposes, including but not limited to, the introduction of spam, viruses or other harmful items which may interfere with the system or network. 
  5. The use of Online Services is subject to the laws and jurisdiction of New Zealand. 
  6. MTL is the owner of all intellectual property rights in its trademarks, copyright and other intellectual property subject to the New Zealand Copyright Act 1994.
  7. All personal information collected through Online Services is subject to the Privacy Act 2020 and the MTL’s Privacy Policy which is located at this link acceptance of these Terms and Conditions is acceptance of the MTL’s Privacy Policy.
  8. Subject to the MTL’s Privacy Policy, data collected (excluding personal information) may be used and disclosed for any of its purposes.

  10. In the event of a dispute between parties, MTL will seek to resolve such dispute and if unable to come to a resolution use mediation or other informal methods of resolution before pursuing resolution through the Courts. 
  11. You are not permitted to use any of MTL’s trade marks, trade names, logos, devices or bylines without prior written consent. 
  12. Access to Online Services may be terminated or suspended at any time by MTL without notice. 
  13. MTL reserves the right to amend these terms and conditions published on our website from time to time effective immediately. 
  14. Login credentials are unique to the individual and/or organisation and are not to be shared with any other person. 
  15. Online Services may be temporarily suspended from time to time for maintenance. 
  16. Information contained within the website is for general purposes only. 
  17. Links to affiliate websites should not be construed as an endorsement, approval or recommendation for any information, graphics, materials, products, or services referred to on those affiliate sites. If you access any links to a third-party website, please ensure you review privacy information and terms and conditions of that third party.
  18. MTL will not be liable for any delay or failure to perform any obligations, including but not limited to, Online Services provided that such failure is beyond the reasonable control and without fault or negligence of MTL.
  19. Content hosted through Online Services is subject to change without consent.
ONLINE TICKET SALES
  1. Online ticket purchase transactions are encrypted to the extent reasonably possible to ensure a secure internet transaction. 
  2. Payment shall be made by credit card, such as Visa, MasterCard or American Express. 
  3. Where you are purchasing a ticket for any individual other than yourself, you agree that you have obtained the express consent of that individual to include their personal information on their ticket and agree to the terms and conditions and the MTL Privacy Policy on their behalf. MTL will not be liable in respect of the personal information of a third party being included on a ticket where you have not obtained consent from the individual to use their personal information including in relation to being entered into any prize draw or competition.
  4. The ticket price and fees are in NZ dollars and are inclusive of GST which may be subject to transaction fees and replacement ticket fees.
  5. Electronic tickets must be printed or presented on your electronic device. 
  6. If printing your ticket, black ink on white paper is required to enable the ticket barcode to be scanned. 
  7. Each electronic ticket has a unique barcode which allows one entry only to The Landing unless otherwise stated. 
  8. Each ticket must be scanned at an authorised entry point. 
  9. Entry may be refused if a ticket is damaged or defaced in any way or has been purchased from a third party. 
  10. MTL does not permit the resale of tickets or their use for advertising, promotional or other commercial purposes including competitions, trade promotions, auctions, prizes, sweepstake, or other purposes without prior written consent. 
  11. MTL may amend these Terms and Conditions at any time by updating them and displaying them on the MTL website and New Zealand Open App. Any variations will only apply to ticket purchases made after the effective date of the updated terms and conditions. If you do not agree with any revised version of these Terms and Conditions, or you cannot comply with it, then you must not access or use any Online Services.
  12. If a ticket is sold or used in breach of clause 10 above, the ticket may be cancelled without a refund or compensation and the bearer of the ticket may be refused admission to any event. 
  13. Conditions of entry are referenced to on the ticket and in the terms and conditions of entry to the Event located at this link.
  14. This ticket cannot be exchanged or refunded except at the discretion of MTL.
  15. If the event is postponed to an alternative date, no refunds will be issued, and your ticket will still be permitted for use on the revised date(s).
  16. If an Event is cancelled you must apply for a refund within a reasonable time. MTL does not offer refunds or exchanges as a result of a change in your personal circumstances.
ENTRY TO EVENT

The New Zealand Open is operated under licence by Millbrook Tournaments Limited (MTL). The right to admission is subject to MTL’s full ticket terms and conditions, at www.nzopen.nz

  1. This ticket cannot be exchanged or refunded except at the discretion of MTL.
  2. MTL may impose restrictions on entering our premises without notice.  
  3. By entering, you acknowledge and agree that you shall comply with MTL’s policies, procedures, and directions to manage the risks to public health and safety. It may be a condition of entry to that a search of a person and/or their possessions will be required at the time of entry to the venue.  
  4. Tickets may be refused if damaged, defaced or are not purchased from authorised points of sale.
  5. Visitors are prohibited from bringing alcohol, illegal substances, animals, bicycles or scooters into The Landing and/or The Landing Bistro site or any other item prohibited by MTL from time to time.  If visitors are advised not to bring an item onto the site and refuse or are found to have these prohibited items on site, they will be asked to leave immediately. Please note that this exclusion does not apply to mobility scooters where approved entry by MTL.
  6. Admission of “service animals” is at the discretion of MTL.
  7. MTL reserves the right to add, withdraw, reschedule, or substitute players and/or vary advertised programmes, venues, seating arrangements and audience capacity as it sees fit.
  8. Admission may be denied to an Event or Venue where any age or other entry restriction is in place if valid identification for that entry reason is requested and cannot be provided.
  9. Persons entering the venue do so at their own risk. To the maximum extent permitted by law, MTL and the ticket seller shall be under no liability whatsoever to persons entering the venue or any third party, any injury, loss, damage or harm to any person or property arising from attendance at the event or site.
  10. MTL reserves the right to revise or amend ticket terms and conditions of sale without notice.
  11. You consent to any image of you on site being used for reasonable publicity purposes by MTL and authorised media.
  12. Acknowledge that drones (remotely piloted aircraft systems) may be operating in and around the site. No unauthorised drone operation is permitted.  
  13. You agree that perpetual use may be made, free of charge, of his/her voice, image and likeness while at the Venue by means of live or recorded video, photographs or other use of media technologies.  
  14. If the event is postponed to an alternative date, no refunds will be issued, and your ticket pass will still be permitted for use on the revised date(s).  
  15. If an event is cancelled you must apply for a refund within a reasonable time. MTL does not offer refunds or exchanges as a result of a change in your personal circumstances.
STANDARD PROMOTION OR COMPETITION RULES

Definitions ‘New Zealand Open’ means all companies in the Millbrook group, including but not limited to Millbrook Tournaments, Millbrook Resort and, The New Zealand Open.

‘Disqualified Participants’ are:

(a) all New Zealand Open employees, all employees of participating sponsors or promoters and/or advertising agencies and their Immediate Families.

(b) all people under the age of 18 years where the prize incorporates air travel or any other element which would be illegal to supply to a person under the age of 18 years.

‘Immediate Families’ include spouses, grandparents, parents, children, and grandchildren, whether by marriage, past marriages, remarriage, adoption, co-habitation or other family extension.

Entry

  1. These Promotion or Competition Rules (‘the Rules’) apply to all New Zealand Open Promotions or Competitions (collectively the ‘Promotion’) conducted on or off air and by means of any medium – online, radio, print, or a on course. The Rules may change from time to time.
  2. If a particular Promotion has specific rules or terms (‘the ‘Specific Rules’) those Specific Rules will apply if there is any inconsistency with the Rules.
  3. Unless otherwise stated in the Specific Rules registration, entry or vote is limited to 1 per person. Where multiple registrations, entries or votes are acceptable, each must be made separately.
  4. Entry into the Promotion is deemed to be acceptance of the Rules and the Specific Rules and confirmation that the entrant has the necessary authority (for example from the bill payer or owner of a telephone) to enter the Promotion.
  5. Entrants’ personal information will be provided to the New Zealand Open and stored on the New Zealand Open’s database. The New Zealand Open Organiser may use this information to contact the entrant electronically for the purposes of populating the post-event report and/or future marketing purposes.
  6. No purchase is necessary to win or participate in the Promotion, unless specified in the Specific Rules.
  7. The Promotion is open to New Zealand Residents only. Disqualified Participants may not enter the Promotion.
  8. The New Zealand Open reserves the right to exclude any person from participating in the Promotion on reasonable grounds.
  9. New Zealand Open reserves the right to refuse to award any prize to an entrant who the New Zealand Open decides (in its sole discretion) has violated the Rules (including the Specific Rules), gained an unfair advantage in participating in the Promotion or won using fraudulent means.
  10. By participating, entrants grant New Zealand Open exclusive permission to use their names, characters, photographs, videos, voices and likenesses in connection with the Promotion and for future promotion and marketing purposes and waive any claims to royalty, right or remuneration for such use.
  11. All entrant personal details must be valid and up to date and will be held by the New Zealand Open and may be used for the purpose of the Promotion and for future promotion and marketing purposes in accordance with the New Zealand Open Privacy Policy (see www.nzopen.com) unless otherwise directed by contestants at the time of entry.
  12. Personal information provided at the time of entry is presumed to be true and, in the case of text or email notification – active, through to and beyond the date of the Promotion’s completion.
  13. Where the Promotion involves texting, the following apply:
    1. Standard sms text charges will apply, unless otherwise stated in the Specific Rules and will depend on the entrant’s particular plan or agreement with their phone service provider.
    2. Any form of automated text message is invalid.
    3. The telephone number from which the entry was made will be stored in a database. The entrant has a two-business-day period from the time of entry to request removal from the database. If no request is made it is deemed acceptance that the information can be used for future promotion and marketing purposes; and
    4. New Zealand Open takes no responsibility for text costs incurred after the Promotion has closed as stipulated in the Specific Rules.

 

Winning a Prize

  1. Only the person who originally entered the Promotion can be awarded the prize (the ‘Winner’).
  2. The Winner will be determined in the manner set out in the Rules or the Specific Rules – if not specified then as determined by the Promoter who shall for this purpose be deemed the judge (the ‘Judge’).
  3. The Judge’s determination of the Winner will be final and no correspondence will be entered into.
  4. The Winner will be notified by email, phone (voice or text), mail or in person and must be available for the preparation of all publicity that may be required by the New Zealand Open. Where attempts to contact the Winner fail (eg when the Winner cannot be contacted by phone after three attempts or mail sent is returned) the Judge will select another winner. If, after successful notification, the prize is not collected within two months of being announced it will be regarded as forfeit.
  5. The Prize is not redeemable for cash or transferable. No other family members, friends, office associates or any other person will be able to participate on the Winner’s behalf. In the event that the Prize specified in the Competition becomes unavailable for any reason, the Promoter may substitute a prize of like or equal value.
  6. Where the Winner is required to claim the prize in person, they must provide proper identification (eg driver’s licence, passport, birth certificate). If the Winner is under the age of 18 years their parent or legal guardian must accompany the Winner or give their prior written consent to the award of the Prize.
  7. The Winner takes the Prize entirely at his/her own risk and indemnifies the New Zealand Open in respect of any claim for any accident, injury, property damage or loss of life that may occur in connection with the prize. The Winner is responsible for all insurance, tax or other costs that may be associated with the Prize. Where the Prize has associated terms and conditions the Winner accepts the Prize subject to those terms and conditions and restrictions.
  8. Where the Prize includes air travel and/or accommodation, either international or domestic (the ‘Travel Prize’):
    1. The winner MUST have valid documentation, including but not limited to valid passports and Visas, which meet the requirements of immigration and other government authorities at every destination.
      1. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities (including any costs associated with delay, will be the sole responsibility of the Winner).
    2. The Winner and their travelling companion (if applicable) must travel together at all times. The Winner is responsible for transport from their residence to their nearest international airport for flight departure and from their nearest international airport to their residence upon returning to New Zealand.
    3. Flight tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. The flight itinerary may have to be adjusted depending on the airline’s departure city and their current flight schedule. Unless otherwise specified, the air travel is economy class.
    4. Any changes to travel dates or additional accommodation outside the travel period specified in the Travel Prize details, made by the winner, which incur additional costs, are to be paid by the Travel Prize winner.
    5. Unless explicitly stated in the Specific Rules, the Winner will be responsible for expenses including, but not limited to, spending money, meals, drinks, transport, laundry charges, activities, incidentals, taxes (excluding departure and any other flight-associated taxes included within the Travel Prize), gratuities, services charges, passports, visas, travel insurance and all other ancillary costs associated with redeeming the Travel Prize. The Winner must obtain travel insurance to protect themselves against additional costs incurred in the event of unforeseen circumstances.
    6. The Travel Prize is not transferable or exchangeable and cannot be redeemed for cash. The Travel Prize must be taken as stated in the Specific Rules and no compensation will be payable if the Winner is unable to use the Travel Prize as stated. For the avoidance of doubt, if the Winner is, for whatever reason, unable to travel on a nominated date during this period, whether the failure was due to reasons beyond the Winner’s control or otherwise, then the Winner will forfeit the Travel Prize.
    7. The Promoter makes no representation as to safety, conditions and other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the website of the New Zealand Ministry of Foreign Affairs and Trade. The winner accepts the Travel Prize at their own risk.
    8. All travel is subject to the terms, conditions and restrictions of the Travel Prize service providers. Any travelling companion included in the Travel Prize (if applicable) accepts the Travel Prize subject to these terms, conditions and restrictions as if references to the Winner in the relevant clauses were to the travelling companion. The Winner and their travelling companion must sign a legal release, in a form acceptable to the Promoter in its absolute discretion, if requested by the Promoter. New Zealand Open Responsibility
  9. The New Zealand Open reserves the right to amend, vary, extend or discontinue a Promotion at any stage, for any reason.
  10. The New Zealand Open takes no responsibility for any inability to enter, complete, continue or conclude the Promotion due to equipment or technical malfunction, busy lines, inadvertent disconnection, texts with a misspelt keyword, texts to an incorrect shortcode, Force Majeure or otherwise.
  11. To the fullest extent permitted by law, the New Zealand Open will not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) or for personal injury as a result of Promotion entry or winning the prize.
  12. Where the Prize is to be supplied by an entity outside the New Zealand Open’s control and that entity fails, for whatever reason, to supply the prize, New Zealand Open has no responsibility for the provision of the Prize and is not obliged to provide an alternative Prize or to take legal action to require the Prize supplier to provide the Prize.

 

Acceptance

  1. Participation in the Promotion is deemed acceptance of these Terms and Conditions.
  2. If the Winner does not accept these Terms and Conditions the prize will be forfeited.
